Lindsay Clancy is on trial in Plymouth Superior Court on three charges of murder in the deaths of her children, Cora, Dawson and Callan Clancy. The prosecution alleges that Clancy intentionally and deliberately killed the children January 24, 2023 after arranging for Patrick Clancy to leave the family home to pick up dinner and medication. The Commonwealth argues that she understood her actions and was criminally responsible at the time. The defense does not dispute that Clancy caused the children’s deaths. It argues that she was suffering from severe post partum depression, mental illness, including post partum psychosis and was not criminally responsible for her actions. Under Massachusetts law, the defense does not carry the burden of proving lack of criminal responsibility. The Commonwealth must prove beyond a reasonable doubt, that Clancy was criminally responsible, in addition to proving the required elements of the charged offenses. The jury must evaluate the evidence and determine whether the Commonwealth has proven the murder charges and Clancy’s criminal responsibility beyond a reasonable doubt.
